Tales from a Trainee Solicitor’s Third Seat

Over the last year, we have followed Josh Horne on his journey as a Trainee Solicitor at EMG Solicitors. Having already completed two seats of his training contract within our Dispute Resolution and Court of Protection (Property and Affairs) departments, Josh now shares his experience in his third seat in our Wills, Trusts and Probate team.

A Trainee Solicitor’s First Day in their Third Seat

Moving into the Wills, Trust, and Probate department brought a fresh wave of nerves, but by now, change was becoming more familiar. Having already moved twice, I was beginning to adapt to the shifts in my training. The team was incredibly welcoming, which helped ease the transition, and I was mainly based within the Gosforth Office. The teams support made the adjustment smoother, and I quickly settled into my new role.

A Typical Day in Wills, Trust and Probate

One of the key lessons I’ve learned in this seat is the importance of Wills, Trusts, and Powers of Attorney. Estate planning is crucial, not just for asset management but to make life easier for loved ones in the event of passing or incapacity. A “typical day” in this department doesn’t really exist, as the work spans across various areas. Each day involves meeting clients, whether for initial consultations to discuss their wishes for Wills and Lasting Powers of Attorney, signing legal documents, or handling probate matters. The role is highly person-centred, requiring direct engagement with clients to guide them through complex legal decisions and concepts.

Working within the Wills, Trusts, and Probate department has been a fascinating experience, offering insight into both the legal intricacies and the real-world implications of estate planning. One particularly interesting moment was being in the department during the 30 October Budget. It was eye-opening to see firsthand how political decisions influence legal frameworks, which in turn affect clients’ financial and estate planning needs. The experience underscored how solicitors must remain attuned to legislative changes, ensuring their advice is not only legally sound but also strategically tailored to help clients navigate shifting laws.

Alongside my work, I am also studying for the SQE. One of the topics covered is Wills, Trusts, and Probate, which has been fascinating as I get to experience both the academic and practical aspects of the subject at the same time. Seeing legal principles come to life in practice has been an invaluable part of my training.

Upcoming Seat

My next move is back to the Court of Protection (Health and Welfare) department—a place I previously worked as a paralegal. I’m excited to return to an area I really enjoy and have significant experience in. However, it will be a new challenge, as the team has grown and evolved substantially, now specialising in more areas of law. I’m looking forward to seeing how the department has developed and continuing my journey in an area of law that I am passionate about.
