The Three Steps to Getting a Divorce

42% of marriages end in divorce in the UK. With such a high number of marriages failing, it is essential that proper advice is taken at the right time to try and make the process as painless as possible for couples.

Here are the 3 steps to ensuring your divorce runs as smoothly as possible:

1. In order to obtain a divorce, you need to prove “irretrievable breakdown” of the relationship. This means that you need to prove that the relationship is undoubtabley over and you can prove that there was an event or series of events that led to this. You can apply for a divorce on the basis of adultery, unreasonable behaviour, separation or desertion. The most common ground is unreasonable behaviour and is the easiest one for many couples to prove.

2. You will then make an application to the court through paperwork, so there is no need to physically attend court. Make sure the court documents are correctly drafted or your application will be rejected.

3. Make sure you have resolved any financial claims at the same time – unfortunately, the divorce only ends your marriage – not your financial ties to one another. If you do not do this, you may find that your ex-spouse can make a claim against you in the future, which will cost even more in legal fees for you.

Divorce is already emotionally stressful enough – so as soon as you see the red flags looming, prepare yourself so that you do not have the added stress of having to go through the process alone.
